A United States Court of Appeals has declared most of President Donald Trump's global trade tariffs invalid. However, the tariffs remain in effect temporarily, giving Trump the opportunity to pursue a lawsuit all the way to the Supreme Court. The Court of Appeals for the Federal Circuit ruled that Trump had exceeded the authority of the International Emergency Economic Powers Act (IEEPA). The court noted that the statute grants the president broad powers in the event of a national emergency, but does not include the right to impose tariffs or similar levies.[1]
This ruling upholds a lower court's earlier ruling that declared Trump's tariff policy unlawful.
