The United States Supreme Court ruled that Donald Trump's tariff policies against many countries were unconstitutional. The president lacked the inherent authority to impose large-scale tariffs on any country. Trump invoked the International Emergency Economic Powers Act (IEEPA) of 1977 as the legal basis. This gave him the power to "regulate" trade in response to emergencies.[1]
Trump's tariff policy sparked strong protests both at home and abroad. Companies complained about the sudden increase in taxes on goods entering the US and feared it would make them more expensive. Lawyers from several US states and small businesses then challenged Trump's policy in the US Supreme Court. They argued that the law Trump used to levy the fees did not even mention the word "tariff" The plaintiffs also asserted that the US Congress did not grant the president tax authority, let alone "unfettered power" to overturn existing trade agreements and tariff regimes. In his ruling, Chief Justice John Roberts agreed with this view. In his opinion, he wrote: "When Congress grants tariff authority, it must do so in very clear terms and with strict limitations.
